Determining Liability

- Breach of duty: Documentation that the at-fault party breached that duty of care in some way

- Damage: Documentation that there are actual damages or costs present, that can be compensated.
Because bodily injury cases are usually managed by the insurance company, they will have different requirements. You may need to show proof of a police report or undergo an audit.
Statute of Limitations
The statute of limitations refers to the amount of time in which an individual has to collect compensation for their injuries. In New Jersey, the statute of limitations on personal injury cases is just two years from the date of the injury. Failing to file your case within this time limit can make it difficult, if not impossible, to collect any compensation.
Bodily injury rules are often set by the individual insurance company. Because bodily injury covers damages to other people, it is on the other party to file within a timely manner.
Collecting Compensation

Compensation in both a personal injury and bodily injury case will cover medical costs and property damages, but they cover the damages of the other party in the event that you are at-fault. Who is responsible for the compensation also differs. In a personal injury claim, you will initially seek compensation from the at-fault party. This could include the other driver, the vehicle manufacturer, the truck driver, or the medical professional. When you file to receive bodily injury compensation, it is usually from the at-fault parties’ insurance provider.
New Jersey is a no-fault state, which means that individuals will first seek compensation from their own insurance provider. Bodily injury coverage is also not required in New Jersey. Failing to have sufficient insurance can leave you personally liable in the event that you found to be at-fault following an accident.
